Any business entity in which an official is a director, officer,partner,trustee, manager or employee. Any business entity in which an official has a direct or indirect investment of $2,000 or more. Il ;I •I .~. ~~ 12 13 Abstentions,Disqualifications &Recusals .Abstentions and Recusals are voluntary decisions not to participate because it may be difficult to put personal interest aside and make a decision solely on the public's interest or because the public will perceive that a personal interest interfered. .Disqualification is not voluntary.The law presumes the official cannot be fair and prohibits that individual from participating in the decision.The determination not to act MUST be accompanied by disclosure. 14 15 Contractual Conflicts of Interest Term "Contract"is liberally construed. SUBJECT:Review of Board of Directors Policy 42,Participation in Community Events and Programs/Sponsorhip Opportunities GENERAL MANAGER'S RECOMMENDATION: At the request of the Board,Board of Directors Policy 42, Participation in Community Events and Programs/Sponsorhip Opportunities (Attachment A),is being presented for discussion. PURPOSE: This staff report is presented to provide the Board the opportunity to review the Board of Directors Policy 42,Participation in Community Events and Programs/Sponsorhip Opportunities. ANALYSIS: The Board requested that Board of Directors Policy 42,Participation in Community Events and Programs/Sponsorhip Opportunities,be presented for review.The board also had an interest in the history of the sponsorships the District has provided in the past and a comparison with other agencies within the County of San Diego.A list of the District's sponsorships and cost from Fiscal Years 2008 thru 2010 is attached (Attachment B).Also attached is a list of the agencies within San Diego County (Attachment C)who have responded to our request for information on their Sponsorhip Guidelines.The list indicates if the agency has a policy for guidelines on sponsorships, sponsorships they have provided and the cost for Fiscal Year 2010, and copies of their policies if they have one. Attachments: Attachment A:BOD Policy 42,Participation in Community Events and Programs/Sponsorhip Opportunities Attachment B:List of District Sporships from FY 2008 -2010 Attachment C:List of Other Agencies'Sponsorships G:IUserDala\DistSecIWINWORDISTAFRPTSlBoard MeelingCalendar9-1-1O.doc ATTACHMENT A OTAY WATER DISTRICT BOARD OF DIRECTORS POLICY Subject Policy Date Date Number Adopted Revised Participation in Community Events and Programs/Sponsorship Opportunities 42 1/8/03 Purpose The purpose of this policy is to provide guidance and consistency to the District's efforts to enhance its strategic communications and public policy implementation efforts.The District will,as a regular business practice,participate in and/or sponsor community events and/or programs,including those organized by not for profit organizations.It is important that these sponsorships are implemented in support of the District's goals as stated in the District's Strategic Plan.The following policy is intended to provide the direction and support necessary for the General Manager and the Board to make these decisions in a manner consistent with overall District objectives. The General Manager shall authorize participation in and/or sponsorship of community events and programs,including those organized by not for profit organizations,in accordance with the General Manager's authorized expenditure and budget authority.Such items shall be reported to the Board as part of the General Manager's annual District budget process. Community and Governance -The District recognizes that it exists in a complex political environment with many important stakeholders,including ratepayers,community groups,citizen's groups,and other local government agencies.Accordingly,the District realizes that it is critical to maintain active and positive relationships with these stakeholders to ensure that their concerns are being effectively addressed. These relationships also serve the important function of disseminating information about the District,the services provided by the District and District efforts related to securing water rights,conservation efforts and water recycling.It also assists in efforts to improve the overall image ofthe District,foster trust and confidence in the District and develop important relationships with community stakeholders and community leaders. The General Manager must evaluate the request or event/program in light of the District's strategic plan and determine ifthe request is consistent with the plan. Approved requests will be forwarded to the Finance department for dispersal in accordance with District practices for dispersal offunds. EXHIBIT 1 ELSINORE VALLEY MUNICIPAL WATER DISTRICT COMMUNITY SPONSORSHIP POLICY Donation and Scholarship Administration (MO #3332,MO #3816,MO #4106) A.Goal.In accordance with EVMWD's efforts to educate the community regarding its public services and to broaden public knowledge of the services provided by EVMWD,all community sponsorship requests should involve activities that will directly disseminate or permit the dissemination of information regarding EVMWD.All sponsorships shall further the District's objective of educating the public regarding the District's role in the community.Staff and the Legislation,Conservation and Outreach Committee shall evaluate all requests for sponsorship to ensure that requested sponsorships and requests for appropriations are intended for the purpose of disseminating information to the public regarding Elsinore Valley Municipal Water District, its public services,employees and mission as a provider of water and wastewater services. B.Background.A stated public information goal of the District is to "develop community support of EVMWD policies through public outreach."As a highly visible public agency,EVMWD has been solicited for club sponsorships,contributions of promotional prizes,yearbook and newsletter advertising,and support of special community events.This sponsorship policy will enable the District to improve community outreach to qualifying organizations through limited sponsorship and advertising support,while remaining in full compliance against legal prohibitions restricting gifts of public funds. C.Review and Funding Authority.There shall be established a "Sponsorships and Donations Fund"in the Public Affairs Department budget,to fund qualifying community sponsorships.The Board shall appoint two ofits members to serve as the Legislation,Conservation and Outreach Committee (LCOC)each year, upon committee appointment in January.The Legislation,Conservation Outreach Committee (LCOC)shall review all requests,direct staff on how to proceed with the requests.Notice of action taken by the Committee will be given verbally or by written report included in monthly Board Meeting packets. Donations and sponsorships to any organization defined as eligible per this policy shall not exceed $300 in any combination of funds and/or water per fiscal year.As necessary,the LCOC and Board of Directors may establish certain contribution limits on the distribution of marketing items promoting EVMWD.It shall be the responsibility of the District's Public Affairs Department to budget,track and maintain records of all sponsorships and contributions accordingly.Awards of Sponsorships and/or Donations shall be limited to once per fiscal year per agency or organization.Sponsorships or donations shall be limited to those organizations within the service boundaries ofEVMWD,and which have an impact on the education and betterment ofthe communities served by EVMWD. D.Eligibility.Eligible sponsorships shall include,but not be limited to,public and non-profit agencies,community organizations,events or publications that are compatible with EVMWD's mission and which otherwise provide opportunities to educate and inform EVMWD's constituents.Cash sponsorships may include activities intended to promote the economic development of communities included within the boundaries of Elsinore Valley Municipal Water District. All sponsorships and contributions shall otherwise be handled in a manner which will not conflict with legal prohibitions restricting gifts ofpublic funds. Applicants must complete the appropriate sponsorship application form or provide the pertinent information by other written correspondence at least thirty (30)days before the deadline for funding of the event.Applicants must indicate which form of public information announcement or acknowledgment will be made to EVMWD.The recipient of a sponsorship or donation must exhibit notice to the public of EVMWD's support,either by signage, acknowledgment in program handouts,verbal announcement,or other means ofcommunication.Awards.On an annual basis,a contribution of $100 to each high school within the Lake Elsinore and Murrieta School Districts will be made.The Lake Elsinore and Murrieta Chambers of Commerce shall determine the appropriate recipients of the scholarship funds provided by EVMWD for their respective high schools.If the Committee determines that funding is inadequate to allow for scholarship donation to the schools,any unused funds may remain to be utilized pursuant to this policy. E.Program Support.Staff ofthe Elsinore Valley Municipal Water District's Public Affairs Department will contact and coordinate the annual donation through the Lake Elsinore and Murrieta Chambers of Commerce to be issued through their Student ofthe Year Programs. B.District Mission:The District's Mission Statement is as follows:"The mission of the Vista Irrigation District is to manage our available resources to meet the present and future needs of our service area by providing a reliable supply of high-quality water in an environmentally and economically responsible manner in an atmosphere of courtesy, integrity and quality of service." 1.15.4 Policy A.It is the District's policy to expend District funds for District-related purposes in accordance with the District's mission.A request for a charitable contribution will not be considered if the contribution does not have a District-related purpose or provide an identifiable direct benefit to the District. B.Staff is authorized to deny requests for charitable contributions that do not meet the District's criteria for charitable contributions as specified in this Policy.If staff believes that there might be such a benefit,the request will be brought before the Board of Directors for consideration. C.In order for a request for a charitable contribution to be considered,it must meet one of the following criteria: VISTA IRRIGATION DISTRICT a.The organization is special district or water industry-related, provides direct benefits to the District,and is one in which the District is a member;or b.The organization provides a service that complements or enhances something the District provides,such as water education programs; or c.The organization provides an identifiable direct benefit or service to the District,such as avoided staffing costs,while perfofI11ing a District-related purpose. D.Charitable contributions outside of the District's service area will not be considered,except for those associated with industry-wide organizations. E.Charitable contributions will not be made to any single individual,or with the intention that the contribution will directly benefit any particular District employee or official.If approved,a charitable contribution must be made in the best interests of the District's ratepayers.
