HomeMy WebLinkAboutDefinition of Eligible Dependents Definition of Eligible Dependents An eligible Dependent of an Employee is: • A spouse. The marriage must meet all requirements of a valid marriage contract in the Employee's state of residence; • A Domestic Partner that meets the following requirements: o two adults who have chosen to share one another’s lives in an intimate and committed relationship of mutual caring. o the Domestic Partnership is established in California when both persons file a Declaration of Domestic Partnership with the Secretary of State pursuant to this division, and, at the time of filing, all of the following requirements are met: (1) Neither person is married to someone else or is a member of another domestic partnership with someone else that has not been terminated, dissolved, or adjudged a nullity. (2) The two persons are not related by blood in a way that would prevent them from being married to each other in this state. (3) Both persons are at least 18 years of age, except as provided in Section 297.1 of the California Family Code. (4) Both persons are capable of consenting to the domestic partnership. • A child under age 26 regardless of marita l or student status. For these purposes a "child" will include: o a natural child; o a legal stepchild; o a child placed under the leg al guardianship of the Employee; o a child who is adopted by the Employee or placed with him for adoption prior to age 18. "Placed for adoption" means the assumption and retention by the Employee of a legal obligation for total or partial support of the child in anticipation of adoption of the child. The child must be available for adoption and the legal process must have begun; o notwithstanding any main support and care requirements, a child for whom the Employee or covered Dependent spouse is required to provide coverage due to a Medical Child Support Order (MCSO) which the P lan Sponsor determines to be a Qualified Medica l Child Support Order (QMCSO) in accordance with its written procedures (which are incorporated herein by ref erence and which can be obtained without charge). A QMCSO will also include a judgment, decree or order issued by a court of competent jurisdiction or through an administrative process established under state law and having the f orce and effect of law under state law and which satisfies the QMCSO requirements.
